• Upload and manage candidate information with proper consent
• Evaluate candidates for job positions
• Access and use features available through your subscription plan

3.2 Restrictions

You agree not to:

• Use the platform in any way that violates applicable laws or regulations
• Upload or share any content that infringes intellectual property rights
• Upload or process personal data without proper legal basis or consent
• Use the platform to discriminate against candidates based on protected characteristics
• Attempt to gain unauthorized access to any part of the platform
• Introduce viruses, trojans, or other harmful code
• Conduct any activity that could disable, overburden, or impair the platform
• Scrape, mine, or extract data from the platform without explicit permission

4. Subscription and Payments

LightningHire offers various subscription plans. By selecting a plan and providing payment information, you agree to:

• Pay all fees associated with your selected plan
• Provide accurate billing information
• Authorize us to charge your chosen payment method

Subscription fees are billed in advance. We reserve the right to change our pricing and billing methods with reasonable notice. Refunds are subject to our refund policy, available upon request.

5. Content and Data

5.1 Your Content

You retain all rights to the content you upload to LightningHire, including job descriptions and candidate information. By uploading content, you grant us a non-exclusive license to use, store, and process that content solely for the purpose of providing and improving our services.

5.2 Data Processing

You agree that you have the right to upload and process any candidate information, including resumes and personal data. You are responsible for:

• Obtaining necessary consents from candidates
• Complying with applicable data protection laws
• Ensuring the accuracy of the information provided

6. Intellectual Property

The LightningHire platform, including its design, text, graphics, interfaces, and code, is owned by LightningHire and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works without our explicit permission.

7. Disclaimers and Limitations of Liability

7.1 Service Provided "As Is"

LightningHire and its services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2 Limitation of Liability

To the maximum extent permitted by law, LightningHire shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the service
• Any unauthorized access to or use of our servers or data
• Any interruption or cessation of transmission to or from the service
• Any bugs, viruses, or harmful code that may be transmitted through the service

8. Indemnification

You agree to indemnify, defend, and hold harmless LightningHire and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the platform, your violation of these Terms, or your violation of any rights of another.

9. Termination

We may terminate or suspend your access to LightningHire immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the platform will cease immediately.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of LightningHire shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes through the platform or by other means. Your continued use of LightningHire after such modifications constitutes your acceptance of the updated Terms.
